In compliance with the Federal Law on the Protection of Personal Data Held by Private Parties (hereinafter, the “LFPD”), we make this comprehensive privacy notice available to you and hereby inform you of the following:
1.- Party responsible for the protection of personal data.
Embarcadero Las Flores Nativitas, with its address for hearing and receiving notices at Calle del Mercado #1, Barrio de Xaltocán, Xochimilco, Mexico City, postal code 16500, is responsible for the processing and protection of your personal data and/or that of your child or ward, as the case may be, that are collected.
2.- Information about our privacy officer and how to contact them.
Our privacy officer is the person within Embarcadero Las Flores Nativitas who, in compliance with Article 30 of the LFPD, has been formally designated to:
Handle requests from data subjects to exercise their rights.
Promote and safeguard the protection of the personal data in our possession.

3.- Personal data we collect.
In order to fulfill the purposes set forth in section 4 (four) of this privacy notice, we will collect personal data within the following categories: (i) identification; (ii) contact; (iii) the content of the publicly accessible comments you make about Embarcadero Las Flores Nativitas on social media; (iv) financial; (v) information regarding your tour and the services you have contracted; (vi) sensitive. With regard to this last category, we inform you of the following:
3.1.- Sensitive personal data.
We do not collect sensitive personal data through direct or indirect means of collection for the purpose of providing you with adequate attention in connection with the service.
For this purpose, we must first obtain your express consent through this privacy notice. Such sensitive personal data will be processed under strict security and confidentiality measures, and reasonable efforts will be made to keep the period of their processing to the minimum necessary.
4.- Purposes of the processing of the personal data collected.
Personal data are collected for the following primary and secondary purposes:
a) Primary.- Purposes that give rise to, and are necessary for, the legal relationship between you and Embarcadero Las Flores Nativitas.

To provide you with the information you request and to process quotes, reservations, purchases, cancellations, and changes.
b) Secondary.- Purposes that are different from, and do not give rise to, the legal relationship between you and Embarcadero Las Flores Nativitas, but that are extremely useful to us in providing you with better service and pursuing our legitimate business interests:
Surveys, evaluation, and follow-up of trajinera tourism services.
To contact you to learn your opinion of, and your experience on, the tour you took.
To inform you about and/or offer you our own or third-party products, services, and promotions.
Marketing, advertising, business prospecting, and profiling.
Strengthening our brands, for which we may select and use comments that you post on social media regarding Embarcadero Las Flores Nativitas.
To enable you to participate in the contests and/or raffles that we organize.
4.1.- Refusal of the processing of personal data for secondary purposes.
If you do not want your personal data to be processed for the aforementioned secondary purposes, or for any of them, you may withhold your consent as of this moment by sending your request to our privacy officer, who will inform you of the procedure to follow to exercise your right. Your refusal in this regard may not be grounds for us to deny you the services and products you request or contract with us.
5.- Transfer of personal data.
In order to fulfill the primary purposes set forth in section 4 (four) of this privacy notice, personal data may be transferred to the following individuals or legal entities, without your consent being legally required under the terms of Article 37 of the LFPD:
Companies or institutions with which we have entered into, or will enter into, a contract in your interest, for the purpose of granting you benefits.
Domestic or foreign third parties with which we have entered into a contract in your interest, when this is required in order to inform you about, follow up on, and pay you any amounts resulting from valid claims. For this purpose, the receiving data controller must be able to identify and contact you.
Companies engaged in car rental, for the purpose of providing you with ground transportation services, provided that you decide to contract such service.
Foreign government authorities, for the purpose of complying with their requirements regarding customer registration.
Restaurants and/or hotels, for the purpose of providing you with meal and/or lodging compensation in the event that you have been affected by an operational irregularity.
Authorities, for the purpose of complying with the applicable legal provisions, as well as for clarifying incidents, exercising any right, handling health-related situations, and attending to cases of emergency or force majeure.
Companies that are part of Embarcadero Las Flores Nativitas and that operate under our same internal processes and policies, for the purpose of providing you with better service and complying with our internal regulations.
Likewise, identification and contact personal data may be transferred to the following legal entities, in which cases we do require you to give us your consent:
Companies engaged in commercial activities, for the purposes of business prospecting and the sale of our own products or services or those of such companies.
Companies engaged in promotional, marketing, and advertising activities, for the purpose of conducting studies and market surveys, disseminating advertising, and informing you of promotions on travel, destinations, and tickets.
Companies engaged in financial activities, for the purpose of offering you products and services of such companies or co-branded products and services.
Companies engaged in tourism activities, for the purpose of promoting their lodging and publicity services in domestic and international destinations.
If you do not express your refusal for us to carry out these transfers, or any of them, we will understand that you have given us your consent. You may express your refusal as of this moment by sending an email to our privacy officer, who will inform you of the procedure to follow to exercise your right.
6.- ARCO Rights.
Under the terms of the applicable regulations, you have the right to know what personal data we hold about you, what we use them for, and the conditions under which we use them (Access). You also have the right to request the correction of your personal information if it is outdated, inaccurate, or incomplete (Rectification); to have it deleted from our records or databases when you consider that it is not being used properly (Cancellation); and to object to the use of your personal data for specific purposes (Opposition). These rights are known as ARCO Rights.
To exercise any of the ARCO rights, you must submit the respective request by email addressed to our privacy officer, who will inform you of the procedure and requirements for exercising those rights, the response times, and the manner in which we will give effect to your right, and who will address any question, complaint, or comment you may have in this regard.
7.- Mechanisms and procedure for revoking your consent.
Under the terms of the applicable regulations, you may revoke any consent you may have given us. However, it is important that you bear in mind that your request will not be granted in all cases, nor will we always be able to stop the use immediately, since we may be required to continue processing your personal data due to a legal obligation.
To revoke your consent, you must submit your request by email addressed to our privacy officer, who will inform you of the procedure and requirements for exercising this right, the response times, and the manner in which we will give effect to your right, and who will address any question, complaint, or comment you may have in this regard.
8.- Options available to you to limit the use or disclosure of personal data.
In addition to the procedure and exercise of the rights provided for in sections 6 (six) and 7 (seven) of this privacy notice, you may limit the use or disclosure of personal data in any of the following ways:
For emails that we send you for promotional, marketing, and/or advertising purposes, you may express your refusal by clicking the unsubscribe link included in each such email, which is located at the bottom of the email.
Likewise, you may send an email to our privacy officer requesting your registration with Embarcadero Las Flores Nativitas so that we do not use your personal information for promotional, advertising, and/or marketing purposes. For more information on this matter, you may contact our privacy officer.
Likewise, you may register with the Public Registry to Avoid Advertising (Registro Público para Evitar Publicidad) of the Federal Consumer Protection Agency (Procuraduría Federal del Consumidor, PROFECO).
